Creek County Possession of Drug Paraphernalia Attorneys

Creek County Possession of Drug ParaphernaliaCreek County Possession of Drug Paraphernalia is a charge you want to avoid at all costs.  While the justice system carries harsh penalties for the crime, social backlash is also an important issue.  Nobody wants the label of “drug addict” or “dealer” to follow them for years to come.  Okla. Stat. tit. 63 §2-405(B) sets out the definition of drug paraphernalia:

“No person shall use drug paraphernalia to plant, propagate, cultivate, grow, harvest, manufacture, compound, convert, produce, process, prepare, test, analyze, pack, repack, store, contain, conceal, inject, ingest, inhale or otherwise introduce into the human body a controlled dangerous substance… .”

As a result of this statute, anything that aids in growing, using, selling, or manufacturing drugs is paraphernalia.  Oklahoma courts also use a set of standards to judge if something is paraphernalia.  These standards are:

– residue is present on the item

– the location of the item relative to actual drugs

– any statements the accused makes during the incident

Creek County Possession of Drug Paraphernalia Punishments:
