– residue is present on the item

– the location of the item relative to actual drugs

– any statements the accused makes during the incident

Creek County Possession of Drug Paraphernalia Punishments:

It is a misdemeanor to possess drug paraphernalia.  A first offense is subject to a year in prison and fines reaching $1,000.  Second offenses also result in a year prison sentence, but fines amounts increase to $5,000.  Third offenses increase fines to $10,000.  As you can see, if the offense is repeated, punishments increase each time.
